Terms of Service

Last updated October 13, 2026 (version 2026-10-13) · Mullion is provided by Aleph Developments

The main points
  • 30 days free to start, and nothing is charged if you cancel during the trial.
  • Plans renew automatically until you cancel; cancel online any time and keep access to the end of the paid period.
  • You own your content and leads. We handle your leads only to run the service — never sold, never used for ads.
  • Only upload photos you have the rights to, and follow your MLS, licence and fair housing rules.
  • Download your data whenever you like.

This agreement

These terms are the agreement between Aleph Developments (“we”, “us”) and the real estate agent, team or brokerage that uses Mullion (“you”). By creating a login or choosing a plan you accept them. If you accept for a business, you confirm you're allowed to bind it.

A signed order or proposal from us can add to these terms (for example, extra work we agree to do for you). If the two conflict, the signed order wins for that point.

The service

Mullion gives you: a website (or a connection to your existing one), listing pages with QR codes, a leads inbox, open house sign-in, a sign and print studio, social images, seller reports, optional custom domains and email forwarding, and 3D home scans (tours). Features may change as we improve the product; we won't remove a core feature you pay for without notice.

You're responsible for your login. Keep your password private, turn on two-step sign-in, and tell us straight away if you think someone else has access. You may add team members; you're responsible for what they do in your account.

Fees, renewal and cancelling

  • Your plan covers one agent, one website, up to 5 live listings (active or pending; sold homes you show don't count) and 5 new home scans each month. Unused scans don't carry over. There is no setup fee.
  • Free trial. Your first plan starts with a 30-day free trial. We take your card when you start, but charge nothing until the trial ends. If you cancel before then, you pay nothing. When it ends, we charge the plan you chose: monthly, or the full year up front if you chose yearly. You get one free trial per Desk.
  • Plans renew automatically every month (or year, if you chose yearly) at the price shown when you subscribed, plus any sales tax, until you cancel.
  • Cancel any time online in the Desk under Plan & domain → Manage billing, or by emailing the contact details below. You keep access until the end of the period you've paid for; we don't charge again after that.
  • Fees already paid aren't refunded for part-used periods, including the rest of a yearly plan, except where the law requires.
  • Extras. Extra listings and home scans are a one-time charge per home, at the price shown before you pay. An extra listing stays covered for as long as that home is listed, including if it goes back on the market. Extras you've paid for but not used stay on your account while you have a plan, and aren't refunded.
  • Printing and domain names are charged per order, at the price shown before you confirm. Domains renew yearly at the price shown unless you turn renewal off.
  • We'll give you at least 30 days' notice of any price change, by email and in the Desk. It applies from your next renewal after that notice; you can cancel before it does.
  • If a payment fails we'll tell you and retry. If it's still unpaid 14 days later, we may pause paid features until it's sorted. Your site and data aren't deleted for a missed payment without further notice.

Your content and your responsibilities

“Your content” means everything you or your team put into Mullion: profile, photos, listings, website text, designs, files, and the details of people who contact you.

  • You own your content. You give us permission to host, copy, resize, display and send it only as needed to run the service for you (for example, to show your listings on your website and make your signs). That permission ends when your content is deleted, except for copies in backups, which roll off on schedule.
  • You must have the rights to what you upload. In particular: listing photos usually belong to the photographer or the listing brokerage, and MLS rules limit where they can appear. Only upload photos you took, paid for with a licence that covers your use, or have written permission to use. You're responsible for complying with your MLS's rules and your brokerage's policies.
  • Your advertising must follow the law and your licence rules — including Washington's advertising rules for brokers (your firm's licensed name must appear, WAC 308-124B-210), the federal Fair Housing Act, and truth-in-advertising. Mullion adds your firm name and Equal Housing Opportunity where it can, but you're responsible for what you publish. Check every listing, price and claim before you publish it.
  • Contacting leads is your responsibility. When you text, call or email people, you must follow the laws that apply to you, including the TCPA and Do-Not-Call rules (for calls and texts) and CAN-SPAM (for marketing emails). Respect “don't contact” marks. Mullion doesn't send texts or marketing messages to your leads; replies open your own phone or email app.
  • AI features (such as AI background art) produce images you should review before use. Don't use an AI image to show what a property looks like, and label it if someone could mistake it for a real home. Demo content in the Desk is labelled as demo and isn't for publication.
  • 3D tours can go in the MLS virtual tour field and on your own site. They don't add a 3D badge on Zillow, which only shows tours from its approved vendors.

Leads and personal information

When buyers, sellers or visitors send you their details through Mullion, you decide how that information is used, and we handle it on your behalf. We will:

  • use it only to provide the service to you, never sell it, never use it for advertising or to train AI models, and never contact your leads ourselves;
  • keep it confidential, limit access to people who need it to run the service, and protect it as described in our Privacy Policy;
  • use only the service providers listed in the Privacy Policy, and tell you before adding a new one that would receive your leads' details;
  • help you answer a person's request to see, correct or delete their information;
  • tell you without undue delay, and in any case within the time the law requires, if we become aware of a security breach that affects your data.

You'll only collect information you're allowed to, and tell people how you'll use it (the forms in Mullion include a short notice and a link to the Privacy Policy).

Acceptable use

Don't use Mullion to: break the law or anyone's rights; post content that's discriminatory under fair housing law, misleading, or that you don't have rights to; send spam; scrape or copy other sites' or the MLS's photos or data without permission; try to get into other accounts or test our security without written permission; or overload or reverse-engineer the service. We may remove content or pause an account that breaks these rules, and will tell you why unless the law or someone's safety prevents it.

Our software

Mullion, its code, design and templates belong to us or our licensors. You get a non-exclusive, non-transferable right to use it while your account is active. Your website keeps working with your content for as long as you subscribe; templates and code stay ours. Suggestions you send us we're free to use without owing you anything.

Availability and backups

We work to keep Mullion available and back up data every night, but we don't promise it will be uninterrupted or error-free, and we're not responsible for outages of the companies we rely on (hosting, email, payments, domain registry) or of your internet connection. Keep your own copy of anything critical — the Desk can export all your data at any time.

Ending the agreement

You can stop at any time by cancelling your plan and asking us to close your account. We can end it with 30 days' notice, or straight away if you seriously or repeatedly break these terms or fail to pay.

Before closing, download your data from the Desk. We'll keep it available for 30 days after the end, then delete it (backups roll off within 90 days). If you have a domain through us, we'll help you move it to your own registrar account.

Disclaimer

Apart from what these terms promise, Mullion is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't give legal, compliance or real estate advice; built-in checks (such as the firm-name check on signs) help, but don't replace your own review.

Limits of liability

To the extent the law allows:

  • neither of us is liable to the other for lost profits, lost business or indirect, special or consequential damages; and
  • our total liability for all claims relating to Mullion is limited to the fees you paid us in the 12 months before the event that caused the claim.

These limits don't apply to our obligations on protecting your leads' data where the law doesn't allow them to be limited, or to anything that can't be limited by law (such as fraud).

Claims about your content

If someone brings a claim against us because of your content or how you used Mullion in breach of these terms (for example, a photographer's copyright claim over a photo you uploaded, or a complaint about how you contacted a lead), you'll cover our reasonable costs and any damages or settlement you agree to. We'll tell you promptly, let you control the defence, and help where reasonable.

Law and disputes

These terms are governed by the laws of the State of Washington, USA. Before going to court, we'll both try to settle a dispute by talking in good faith for 30 days. Any court case will be in the state or federal courts in King County, Washington. Either of us can still bring a claim in small claims court.

Changes to these terms

We may update these terms. For changes that affect your rights we'll give at least 30 days' notice by email and in the Desk, and ask you to accept them when you next sign in. If you don't agree, you can cancel before they apply.

General

These terms (with any signed order and the Privacy Policy) are the whole agreement between us about Mullion. If a part isn't enforceable, the rest still applies. Not enforcing a term isn't a waiver. You can't transfer the agreement without our consent; we can transfer it as part of a sale or reorganisation of the business. Neither of us is responsible for delays caused by events beyond reasonable control. Notices to you go to your account email; notices to us go to the contact details below.
